These Terms & Conditions govern your use of the UptimeMonitorX service operated by Poulima Infotech Pvt Ltd. By using our service, you agree to be bound by these terms.

1. Service Description

UptimeMonitorX provides comprehensive website and infrastructure monitoring services, including but not limited to:

• HTTP/HTTPS website monitoring with customizable methods (GET, HEAD, POST, PUT, PATCH, DELETE), headers, and request bodies
• TCP port monitoring, Ping/ICMP monitoring, DNS monitoring, and server monitoring
• Keyword monitoring for content verification
• SSL certificate expiry monitoring and security grading
• Domain expiry tracking via RDAP protocol
• Heartbeat/cron job monitoring with configurable intervals and grace periods
• Lighthouse performance monitoring for mobile and desktop
• Multi-region monitoring from 30+ global locations
• Incident management with root cause classification, severity levels, and diagnostics
• Public status pages with custom branding
• Multi-channel alerting: Email, Slack, Discord, Telegram, WhatsApp, and Webhooks
• Escalation policies and on-call management
• Customizable dashboards with drag-and-drop widgets
• REST API (v1) with API key management
• Team collaboration with role-based access control
• Maintenance windows for scheduled downtime
• Audit logging of all account activity
• Built-in support ticket system and community forum
• Analytics, SLA reports, and CSV/PDF export

2. Account Registration

• You must provide accurate and complete information during registration
• Email verification is required to activate your account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to create an account
• One person or entity may not maintain more than one free account

3. Acceptable Use

You agree not to:

• Use the service to monitor URLs or servers you do not own or have authorization to monitor
• Attempt to overload, disrupt, or interfere with our service infrastructure
• Use the service for any illegal or unauthorized purpose
• Share your account credentials with unauthorized parties
• Reverse engineer, decompile, or attempt to extract our source code
• Use the API in a manner that exceeds your plan's rate limits (Free: 100/day, Pro: 5,000/day, Business: 50,000/day)
• Create or distribute status pages containing misleading or false information
• Use notifications or webhooks for spamming or unsolicited messages

4. Subscription Plans & Payments

• A free plan is available with up to 5 monitors, 5-minute check intervals, 1-day check history, and limited features
• Pro plan ($6/mo) provides up to 50 monitors, 1-minute intervals, 30-day history, and advanced features
• Business plan ($24/mo) provides up to 200 monitors, 30-second intervals, 90-day history, and full features
• Payments are processed securely through PayPal (international currencies) and Cashfree (INR/India), supporting credit/debit cards and other local payment methods
• Plan upgrades take effect immediately; downgrades take effect at the end of the current billing period
• Refunds are governed by our Refund Policy

5. Service Availability

We strive to maintain high service availability but do not guarantee 100% uptime of the monitoring service itself. We are not liable for any damages arising from service downtime, delayed alerts, monitoring failures, or notification delivery failures across any channel (email, Slack, webhooks, etc.).

6. Data & Privacy

Your use of the service is also governed by our Privacy Policy. We take data protection seriously and implement industry-standard security measures including encrypted storage, hashed passwords (bcrypt), rate limiting, and comprehensive audit logging.

7. API Usage

Access to the UptimeMonitorX REST API is subject to your subscription plan's limits. API keys are personal and must not be shared publicly. We reserve the right to revoke API access for misuse, abuse, or activity that impacts service performance for other users.

8. Status Pages

Public status pages hosted on our platform must accurately represent the status of your services. Custom CSS and branding on status pages must not impersonate other companies or services. We reserve the right to remove status pages that contain harmful, misleading, or offensive content.

9. Third-Party Integrations

Our service integrates with third-party platforms (Slack, Discord, Telegram, WhatsApp, Cashfree, Google PageSpeed). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or performance of third-party services.

10. Intellectual Property

The UptimeMonitorX service, including its design, code, features, and content, is the intellectual property of Poulima Infotech Pvt Ltd. You may not copy, modify, or distribute any part of the service without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, Poulima Infotech Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the service, missed or delayed monitoring alerts, or third-party integration failures.

12. Account Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time from your account settings. Upon termination, your data will be removed in accordance with our data retention policy (within 30 days).

13. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.

14. Governing Law

These terms are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Guntur, Andhra Pradesh, India.
